As mentioned by many media, a decisive position on the CBD <\/a>came from the UN in 2020, which then influenced its production and marketing in Europe. The UN has, in fact, eliminated cannabidiol from the list of drugs without medical properties.<\/p>\n\n\n\n

In fact, there are several studies around the world, from authoritative sources, that highlight how these substances can be beneficial for certain diseases.<\/p>\n\n\n\n

With so many positive points and known benefits, the European laws had to adapt and we now have a full legality of CBD products in Europe ...<\/p>\n\n\n\n

CBD, CBD flowers and other CBD oils: relevant new laws<\/strong><\/p>\n\n\n\n

As a result of these considerations, in 2020 we saw what can be defined as a landmark decision by the European Court of Justice, which states that no country within the European Community is allowed to prohibit the marketing of CBD, if it is produced according to the law in a member country.<\/p>\n\n\n\n

This historic decision has, in fact, forced Member States to review their internal policies and to intervene with specific regulations.<\/p>\n\n\n\n

For example, in Italy, the law that regulates the cultivation and sale of these products is 242 and highlights how the entire supply chain can process certified CBD, with a THC concentration below 0.2 %, while no limit is expressed on the percentage of cannabidiol precisely, as it is not considered a psychotropic substance.<\/p>\n\n\n\n

Therefore, in Europe, and therefore in France, it is totally legal to sell and buy these products if they are certified and respect the law, however it must be stressed that the Italian law has a specific legislative gap on the use of the products, an element not mentioned in the above mentioned law.<\/p>\n\n\n\n

As for CBD oil, it is possible to find it totally free of THC, these are mixed with other natural oils and can have different benefits.<\/p>\n\n\n\n

Let's take a closer look at some of the European countries and the evolutions to come in the face of the laws currently in force...<\/p>\n\n\n\n

The Netherlands and CBD<\/strong><\/p>\n\n\n\n

The Netherlands is considered particularly laid back when it comes to intoxicating drugs. What's interesting, however, is that recreational cannabis use has been decriminalized in the country, and as a result, marijuana and hemp are completely legal, but CBD is not.<\/p>\n\n\n\n

There are strict rules for CBD in the Netherlands. CBD, which is extracted from hemp, is legal, but the THC content must not exceed 0.05 %.<\/p>\n\n\n\n

Austria and CBD<\/strong><\/p>\n\n\n\n

Until the end of 2018, CBD was sold more or less uncontrolled in Austria, and quality assurance was virtually non-existent. Then, there were changes regarding the marketing of CBD in Austria. From that point on, CBD products were no longer sold as medicines or dietary supplements.<\/p>\n\n\n\n

However, there are exceptions for some patients for whom treatment with medical CBD would be beneficial due to their illness. As before, cannabis extracts, cannabis flowers and hashish can be legally purchased in Austria, but the condition is that they contain less than 0.3 % THC.<\/p>\n\n\n\n

The sale can take place via online stores or also local stores if the products are labeled as flavored products.<\/p>\n\n\n\n

CBD in Poland<\/strong><\/p>\n\n\n\n

In Poland, CBD oil is legal. However, the prerequisite is that the oil is obtained from industrial hemp and has a THC content below 0.2 %. In addition, the product must have been available in Poland for several years.<\/p>\n\n\n\n

CBD can be purchased in health food stores in Poland and is also available in stores selling alternative medicine. Poland is one of the most successful countries in growing hemp and exporting CBD products.<\/p>\n\n\n\n

But, what does the law say in other countries close to Europe, and what are the risks of ending up with CBD cannabis on me in these countries?<\/p>\n\n\n\n

CBD in Lithuania<\/strong><\/p>\n\n\n\n

In Lithuania, the cultivation of hemp plants containing less than 0.2 % THC is allowed, but only for fiber and seeds. CBD is therefore prohibited.<\/p>\n\n\n\n

In January 2019, a new bill was proposed to allow the use and sale of so-called cannabis edibles that contain no more than 0.2 % of THC.<\/p>\n\n\n\n

As a result, CBD is still prohibited. The only hemp products legally available in Lithuania are hemp protein, hemp seed oil and hemp flour.<\/p>\n\n\n\n

CBD in Malta<\/strong><\/p>\n\n\n\n

In Malta, CBD is only legal if there is a medical prescription. Nevertheless, in many stores, CBD products are also sold without a prescription. The police don't seem to care, so CBD is more of a grey area in this country.<\/p>\n\n\n\n

CBD in Monaco<\/strong><\/p>\n\n\n\n

Cannabis is absolutely illegal in Monaco. This also applies to the use of products made from the cannabis plant for medicinal and recreational purposes.<\/p>","protected":false},"excerpt":{"rendered":"
